Full Booking Terms and Conditions

Upon registration, you’ll be asked to sign a form acknowledging the following:

Agreement

The terms and conditions set forth in this agreement plus the Release of Liability, Assumption of Risk, and Indemnity Agreement plus the Registration Form constitute the entire understanding and agreement between you and WanderTours LLC, its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, associates, volunteers, successors, assigns and contractors (collectively, “WanderTours”) with respect to any and all bookings, tours or transactions made with WanderTours. By signing this agreement, you accept all of the terms in this agreement and direct us to perform services on your behalf.

Reservation

You may reserve space on a tour by completing and submitting the Registration Form through our website and by making payment for the deposit amount to: WanderTours, PO Box 16102, Seattle, WA 98116. A booking is not final until you submit a signed copy of the Registration Form and receive a receipt for your deposit from us.

Deposits and Final Payment

Any refunds will be sent by check within two weeks of our receiving written notification of your cancellation (email notification is fine). If Beth is traveling when you cancel, it may take longer than two weeks to get your refund check out to you. She’ll mail it as soon as she can upon returning to the U.S.!

The deposit amount listed on the website for this tour is required to secure your place on this tour, and includes any non-refundable costs charged by our outside suppliers. Final payment is due according to the tour-specific Registration Form.

Payments may be made by credit card via PayPal, Venmo, check or wire transfer. If you pay your deposit by check, we cannot confirm your reservation until your payment has cleared the bank. Checks returned by the bank will incur a $25.00 returned check fee.

While we do accept major credit cards, you must provide a click and/or signed authorization for every payment. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause (excepting fraud), including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions. In the event you attempt to chargeback, reverse, or recollect a booking payment already made without the authorization of WanderTours LLC, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection, including, without limitation, attorney fees.

Cancellations by You and Fees

Cancellation fees and how to effectively cancel are stated in the tour-specific Registration Form, and those terms are binding on you. No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason. There are no exceptions to the cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family, or medical emergencies, or any other circumstances beyond our control. For this reason, we strongly encourage you to purchase trip cancellation and interruption insurance and we require evacuation insurance for our trek tours.

You are responsible for returning a signed copy of these Terms & Conditions and the Waiver Agreement to WanderTours no later than 90 days before the departure date of this tour. If a booking is made fewer than 90 days before the departure date of this tour, the Waiver Agreement and this agreement must be signed and returned to WanderTours within 48 hours of receipt by you. Failure to timely review, sign, and return the Waiver Agreement shall be treated as a cancellation of your booking, and the specific tour cancellation fee schedules will be applied.

If a refund is due, refunds will be sent by check within two weeks of our receiving written notification (including via e-mail) of your cancellation. If Beth is traveling when you cancel, it may take longer than two weeks to receive your refund check. She will mail it as soon as she can upon returning to the office.

Changes by You

It is your responsibility to be ready to embark on the tour as specified in the itinerary. WanderTours is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Cancellations or Changes by Us and Flexibility

You acknowledge that the amenities, accommodations, transportation, route, schedule and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems and other unforeseeable factors. No refunds under this paragraph will be provided due to cancellations or changes due to Force Majeure (as defined below).

Force Majeure

“Force Majeure” means any circumstances beyond the reasonable control of WanderTours, LLC, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, epidemics, pandemics, quarantine, government intervention, weather conditions, and unforeseen circumstances. WanderTours, LLC will not be deemed in breach of this agreement or otherwise liable to you by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure.

If WanderTours, LLC and/or any of its Suppliers are affected by Force Majeure, we or the supplier shall be entitled to, and may in our or their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour, offer a travel credit, or provide a refund less applicable cancellation fees. Regarding civil unrest, once WanderTours, LLC has investigated the prevailing situation, as it deems fit, it shall remain in WanderTours’, LLC sole and absolute discretion whether to proceed with the tour.

Travel and Evacuation Insurance

The tour price does not include travel insurance. Due to the uncertainty caused by COVID-19, and to protect your financial investment, WanderTours, LLC has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available. Should you fail to purchase travel protection coverage, WanderTours, LLC shall not be liable for any losses howsoever arising.

Comprehensive travel insurance, including additional cancel for any reason coverage, may cover trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.

In the event you do not purchase cancel for any reason coverage, you will be required to sign a waiver acknowledging the cancellation fees and absolving WanderTours, LLC of any refunds outside of the Booking Terms and Conditions.

We also require participants on our trek tours to purchase evacuation insurance. You agree to obtain sufficient insurance to cover the cost of the tour and to accept all financial risk and other risks if you fail to do so, including but not limited to being left in a dangerous situation if you are unable to be evacuated through your own devices (e.g., insurance and/or available cash on hand).

Complaint Procedure

If you have a complaint during your tour, you must promptly notify WanderTours or your tour leader of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from WanderTours. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to WanderTours within thirty (30) days of the tour’s end date. WanderTours will not accept any liability for claims received after this period.

Compliance with Local Laws and Tour Etiquette

You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, WanderTours or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour. No refunds will be provided in the event of a participant’s removal from the tour.

Limitation of Remedies

You agree that the sole remedy for any default by WanderTours arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, WanderTours shall not be liable for any special, consequential, indirect, incidental or other damages arising out of this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if WanderTours has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Severability and Merger

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

Successors and Assigns

This agreement shall inure to the benefit of and be binding upon WanderTours and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Applicable Law and Choice of Forum

Any dispute arising out of this agreement, including all tort claims – whether such dispute arises in contract or in tort or otherwise – shall be resolved exclusively by the state and federal courts located in Seattle, Washington. The laws of the State of Washington, USA, govern this agreement. You agree that you will only bring claims against WanderTours, LLC in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. I have read this entire agreement, and I am signing it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. My signature applies to all pages of this agreement.
